Terms of Service

These Terms of Service govern access to and use of the ARify platform and publisher dashboard operated by D3 Digital Services Limited (“ARify”, “we”, “us”). By creating an account or using the service, you also agree to our Privacy Notice and Customer Data Processing Agreement.

1. Acceptance of Terms

By accessing or using the ARify platform, you agree to be bound by these terms. If you do not agree to these terms, you may not use our services.

2. Accounts and Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account and for all activities that occur under your credentials.

3. Acceptable Use

You agree not to use the platform to distribute harmful, illegal, or unauthorized content. ARify reserves the right to suspend or terminate accounts that violate our acceptable use policy.

4. Intellectual Property & customer ownership

You retain all rights to the content you upload. By using ARify, you grant us a license to host, process, and display your content strictly for the purpose of providing the service.

• You retain all rights in content you upload or create in ARify (books, images, audio, video, copy, and branding).
• You confirm you have the rights needed to upload and publish the content you use with ARify.

5. Confidentiality

• Each party must keep the other party’s confidential information secure and use it only to perform under these terms.
• Confidential information includes account credentials, unpublished content, commercial terms, and technical configuration.
• Obligations do not apply to information that is public, independently developed, or required to be disclosed by law.

6. Data export and deletion

• You may export your account content and related data on request while your account is active, subject to reasonable technical limits.
• You may request deletion of your account and associated customer content. We will delete or anonymise it within a reasonable period, except where we must retain records for legal, security, or accounting reasons.
• After subscription ends, we may delete inactive content after a retention period unless a longer hold is agreed in writing.

7. Subscriptions and Billing

Fees are billed in advance on a recurring basis. All fees are non-refundable unless required by law. We reserve the right to change our pricing with 30 days notice. Current plans are shown on our pricing page.

8. Security & compliance

We maintain appropriate technical and organisational measures for the service. D3 Digital Services Limited holds Cyber Essentials certification and is registered with the UK Information Commissioner’s Office (ICO). Further detail on hosting, encryption, backups, access controls, and incident response is in our Privacy Notice and Data Processing Agreement.

9. Limitation of Liability

ARify provides the service “as is”. We shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. Except where the law does not allow limitation, our aggregate liability arising from these terms is limited to the fees you paid us for the service in the 12 months before the claim.

10. Termination

We may terminate or suspend your access to the platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

11. Governing Law

These terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
